Terms of Service

1. About Spotzy

Spotzy is a peer-to-peer parking marketplace operated by Spotzy.be (CBE: 1037748560), registered in Belgium. We connect parking spot owners ("Hosts") with drivers looking for parking ("Spotters"). By using Spotzy, you agree to these Terms of Service.

2. Eligibility

• You must be at least 18 years old to create an account
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• One account per person — duplicate accounts may be suspended

3. Host responsibilities

• You must have the legal right to rent out the parking spot you list
• Listing descriptions and photos must be accurate and up to date
• You must honour confirmed bookings unless cancelled within the allowed policy
• You must connect a valid Stripe payout account to receive earnings
• You are responsible for declaring income from Spotzy to Belgian tax authorities

4. Spotter responsibilities

• You must use the parking spot only during the booked period
• You must not damage the parking spot or surrounding property
• You must vacate the spot on time at the end of your booking
• You must not use the spot for storage, commercial activity, or any illegal purpose

5. Pricing and payments

• Hosts set their own hourly net rate; Spotzy calculates daily, weekly, and monthly discounts
• Spotzy charges a platform service fee on each booking, shown before payment
• All payments are processed securely through Stripe
• Belgian VAT (21%) applies to the platform fee; Host VAT depends on their tax status
• Refunds follow the cancellation policy displayed at booking time

8. Prohibited conduct

• Creating fake listings or reviews
• Circumventing the payment system (off-platform transactions)
• Harassment, discrimination, or abusive behaviour towards other users
• Using the platform for any illegal activity
• Attempting to gain unauthorised access to the platform or other users' accounts

6. Cancellations

Both Hosts and Spotters may cancel bookings subject to the cancellation policy in effect at the time of booking. Repeated no-shows or late cancellations may result in account restrictions.

7. Disputes

If a dispute arises between a Host and a Spotter, both parties should first attempt to resolve it via in-app chat. If no resolution is reached, either party may open a dispute through the platform. Spotzy will review disputes and may mediate, but is not liable for the outcome.

9. Limitation of liability

Spotzy acts as an intermediary platform. We do not own, manage, or control any parking spots listed on the platform. We are not liable for damage to vehicles, personal injury, or any loss arising from the use of a parking spot. Our liability is limited to the platform service fee paid for the relevant booking.

10. Account termination

You may delete your account at any time from your profile page. Spotzy may suspend or terminate accounts that violate these terms. Upon deletion, your personal data is removed in accordance with our Privacy Policy.

11. Governing law

These terms are governed by Belgian law. Any disputes shall be submitted to the courts of Brussels, Belgium.

13. Changes to these terms

We may update these terms from time to time. When we do, we will update the version date at the top of this page. Continued use of Spotzy after changes constitutes acceptance of the updated terms.
